Mr. Chief Executive, the below proposal is presented to you for your approval or veto.
Citizenship Act
Title
1. This Act shall be cited as the Citizenship Act
Definition
2. A citizen of Spiritus is a person who has been granted citizenship in accordance with this Act.
Eligibility
3. Any person shall be eligible for citizenship, provided that they
(a) have a nation in Spiritus, and
(b) are not already a citizen of Spiritus, and
(c) have not been declared Persona Non Grata, and
(d) have not been lawfully banned from the region.
Procedure
4. The Chief Executive may prescribe the manner in which a person can apply for citizenship. The application process must be implemented in such a manner that it is accessible to eligible persons with access to the forum.
5. Upon receiving the application, the Chief Executive shall determine whether to confer citizenship. The Chief Executive may deny an application only if, in his or her best judgment, granting citizenship would be prejudicial to the security or welfare of the region or community of Spiritus.
6. Before acceptance of the application becomes effective, any one of the members of the admin team designated therefor shall conduct a security check, and the application of a person failing such a security check shall be deemed rejected. The decision is final and nonreviewable. Admins shall make all reasonable efforts to resolve security concerns together with the applicant whenever possible.
7. The Chief Executive shall act on any application for citizenship within seven (7) days.
Appeal
8. In the absence of a judiciary, applicants rejected by the Chief Executive may appeal the decision to the Legislature, in which case sole jurisdiction over the application vests in the Legislature. It may accept the application with a simple majority vote. Section 6 shall apply. The Legislature shall not exercise this power unless it finds that the Chief Executive has clearly violated this Act in processing the application.
Non-removal; exceptions; forfeiture
9. No citizen of Spiritus shall be stripped of their citizenship except as a criminal sanction.
10 (a) Nothing in this Act shall be construed to limit or abridge the power of the admin team to remove people administratively
(1) whose presence poses a clear and present danger to the region or community of Spiritus, or
(2) who persist in gravely violating the Terms of Service of NationStates, Proboards, or Discord despite sufficient warning, or
(3) who persist in gravely violating any rules, guidelines, and community standards prescribed by the admin team despite sufficient warning.
(b) People so removed shall be deemed to have forfeited citizenship.
11. Nothing in this Act shall be construed to limit or abridge the power of the Chief Executive or Delegate or their designates to temporarily remove the nations of people for just cause during a game or special event. Such removal must be limited to the duration of the game or special event, and does not in any way affect citizenship.
Delegation; limits
12. The Chief Executive may delegate his powers and responsibilities under this Act to another citizen, to whom the provisions of this Act then apply in full.
