Elections Act
Title
1. This Act shall be cited as the Elections Act.
Definition, scope
2. For the purpose of this Act, "Supervisor" shall mean the person administering the election or referendum.
3. This Act shall govern every election or referendum provided for under the Constitution or statutory law, unless otherwise specified by the Constitution or statutory law.
Eligibility for office; voting rights
3 (a). Any citizen of Spiritus is eligible to stand as a candidate in any election under this Act unless otherwise provided for by the Constitution.
(b). Any citizen of Spiritus has the right to vote in an election or referendum.
(c). No non-citizen is eligible to vote in any election or referendum, or stand as a candidate in any election.
4. A person elected to an office under the Constitution who already holds two (2) offices under the Constitution will not take office until he or she has resigned from one or both of those offices.
Supervisor
5. Any procedure shall be administered by a Supervisor, who must be a forum administrator or the Chief Executive, Delegate, or Chair Potato, in a manner consistent with this Act. The Supervisor may prescribe additional measures or procedures as long as they do not conflict with any constitutional or statutory provision.
Elections
6. The Supervisor shall provide for a place on the forum for nominations no less than four (4) and no more than six (6) days before the commencement of voting. Candidates shall indicate by posting there that they stand in the election.
7. The Supervisor shall clearly announce in the nominations thread the time and date when voting is scheduled to commence, and shall instruct that candidates may begin campaigning immediately after declaring their candidacy.
8. The Supervisor shall provide for a place on the forum for voting, accessible by all citizens.
9. Voting shall last no less than four (4) and no more than six (6) days. The Supervisor shall clearly announce in the voting thread the time and date when voting is scheduled to close.
10. At the end of the voting period the Supervisor shall announce the result. The candidate with the most votes not already seated shall be deemed elected until all open positions are filled in turn. In the event of a tie a runoff election is to be conducted, to start 48 hours after the announcement of the result.
11 (a). If a runoff election between candidates for the Legislature results in a tie, the Legislature may decide to leave the remaining seats unfilled until the next regular election, or instruct the Supervisor to conduct a new full election, including a new nominations period, for the remaining seats only. Should the Legislature fail to act within four (4) days of the announcement of the result, it is deemed to have ordered a new election.
(b). If a runoff election between candidates for the office of Chief Executive or Delegate ends in a tie, and the incumbent is one of the candidates, he or she shall be deemed reelected.
(c). If a runoff election between candidates for the office of Chief Executive or Delegate ends in a tie, and the incumbent is not one of the candidates, the Supervisor shall conduct a new full election, including a new nominations period.
Constitutional Amendments
12. The Legislature may propose a constitutional amendment by resolution.
13. The Chairpotato of the Legislature must put such a proposed amendment to a vote by the citizens of Spiritus assembled as soon as feasible. The provisions about elections shall apply unless otherwise provided.
14. The Chairpotato shall announce the referendum on Discord, or cause it to be announced there, in a timely manner.
15. Voting shall commence immediately, and last no less than seven (7) and no more than ten (10) days.
Recall of Elected Official
16. The Legislature may initiate a recall election by passing a recall motion and invoking this provision.
17. The Chairpotato of the Legislature must put the proposed recall to a vote by the citizens of Spiritus as soon as feasable. The provisions about elections shall apply unless otherwise provided.
18. The Chairpotato shall announce the recall vote on the Spiritus Discord server, or cause it to be announced there, in a timely manner.
19. Voting shall commence immediately, and last no less than seven (7) and no more than ten (10) days. If at least two thirds of the votes cast are in favor of the recall, it passes. Otherwise, it is rejected.
Other provisions
20. Notwithstanding the announced end date and time, any otherwise valid vote cast between opening and closing of the voting period is valid.
21. In a vote between an option in the affirmative and an option in the negative, any citizen may place their abstention on the record by voting Abstain or Present.
