The request poses two (2) questions: - Does the Constitution of Spiritus give the Legislature, through either explicit or implied powers, the authority to define, limit, or otherwise regulate the Judiciary of Spiritus with a legislative act, such as the Judiciary Act?
- To what extent are the three branches of government separated and to what extent are the powers distributed or balanced by the current Constitution?
Lego is a citizen, and thus has standing to seek an advisory opinion under section 4(c) of the Judiciary Act. The request is GRANTED limited to question 1, and I'm assigning it to myself. For question 2 I'm exercising discretion under section 6 id. to present it to the full Court once we have one. Questions regarding separation of powers under current law are among the most fundamental ones for a judiciary, and even though advisory opinions do not constitute binding judgments, I believe it is best to not have a single person decide. So ordered.
