Executive Delegation Act
Limitations
7. The Chief Executive shall not delegate all his or her powers under the Constitution to a single member of the executive government without just cause. A leave of absence or emergency leave is always deemed just cause.
8. The Chief Executive remains responsible for the actions of the members of the executive government at all times.
9. Executive power shall only be delegated to citizens of Spiritus.
Title
1. This Act shall be cited as the Executive Delegation Act.
Definition
2. A "member of the executive government" shall be defined as a citizen to whom the Chief Executive has delegated the exercise of executive power.
Record requirement
3. The Chief Executive is mandated to create a post in an appropriate place on the forums that is accessible to at least every citizen of Spiritus that contains a roster of the executive government.
4. For every member of the executive government, the Chief Executive shall state: their name, department, official title, the executive power delegated whenever the extent of delegation is not apparent from the official title, and date of appointment or most recent reappointment.
5. Spiritus officials such as ambassadors who are not exercising a significant degree of autonomous discretion are exempt from the record requirement. Notwithstanding, the Legislature encourages the creation of public departmental rosters.
Removal, exemption
5. All delegation of executive authority ends upon the conclusion of a Chief Executive election, or upon the recall of the Chief Executive. Nothing in this Act shall be construed to prevent or limit the Chief Executive's authority to reappoint members of the executive government.
6. Officials exempted from the record requirement are likewise exempt from automatic removal.
