As Clandestine Overseer of the Fried Potato Sector and the responsible party for the Holy Empire of the Divine Twelvefold Sliced Cheese's flag itself, I would find it most useful, for determining whether the case in question violates the RFA, to hear a statement from the original creator of the flag.
As you most certainly are aware, flags, whether through use of pictures or not, whether adhering to heraldic principles or not, carry meaning and information, often historical, moral, ethical or philosophical in nature, through the medium of symbolism im colours, shapes and figures and their presentation and juxtaposition. In some cases this extends to the smallest details of a flag, for example the exact number of stars on a flag representing the number of founding members or states; in other cases, small variations, while technically still an alteration, still carry the same "statement", so to say, of the flag in question; a good example would be a different shade of red in a simple-colour-coded nation flag, that would still be easily recognizeable.
From the evidence that was provided, it is apparent to see that the flag of Spiritus can be cleanly separated in two sections; the tree in the center, which always stayed present in the alternate flags, and the eight nature-coloured rectangles to the sides, which were removed or replaced. The defendant, truthfully, stated that "every temporary change of the flag still had Spiritus related imagery". While this is correct, the question is not whether the tree portion of the flag is Spiritus related imagery; the question, moreso, is whether the tree is the central, or even sole, important Spiritus imagery necessary to represent our region to the world; or, in other words, whether the nature-coloured rectangles carry a significant portion of Spiritus history and heritage that, through ommission, renders the flag incapable of fulfilling its intended purpose of being a symbol of the spirit of Spiritus as a whole.
That being said, I also think an explanatoin about the symbolism of our flag would be most interesting and educational, especially for newer members of the region, and preserve the history and heritage of Spiritus before they gets lost to time.
