The Vacancies, Leave, and Succession Omnibus Act
Title
1. This Act shall be cited as the the Vacancies, Leave, and Succession Omnibus Act (VALSOA).
Scope, definitions
2. This Act shall provide an order of succession for an Acting Chief Executive to temporarily step in in the event of a vacancy until it can be filled, provide a mechanism to formally declare a vacancy, and address leaves of absence.
3. (a) A leave of absence is a period of time wherein an official is unable to fulfill the duties of their office.
(b) An acting official is a citizen of Spiritus who is temporarily entrusted with the powers and duties of a constitutional office without actually holding it.
(c) Notwithstanding subsection (b), an Acting Delegate is a citizen of Spiritus with Regional Officer authority to the extent possible without personally becoming World Assembly Delegate, who temporarily fulfills the duties of the constitutional office of Delegate.
Vacancies
4. An office is vacant if the holder resigns by public declaration or if the office is declared vacant.
5. If a Legislator takes an unannounced leave of absence, any member of the Legislature may introduce a resolution to declare the seat vacant after 7 days of absence. Upon taking notice of the motion, the Chair Potato shall attempt to contact the unavailable legislator. If communication cannot be established within 48 hours, or with the consent of the unavailable legislator, the resolution shall be put to a vote. The Legislature may provide for an alternative procedure in the event of an unannounced leave of absence of the Chair Potato.
6. If the Chief Executive or the Delegate take an unannounced leave of absence, any citizen of Spiritus may petition the Supreme Court to declare the position vacant after 7 days of absence. The Chief Justice shall attempt to contact the unavailable official. If communication cannot be established within 48 hours, or with the consent of the unavailable official, the Chief Justice shall declare the position vacant. Should the position of Chief Justice be vacant at the time, the petition may be presented to the Legislature and processed as if the absent official were a legislator.
7. If the Chief Justice takes an unannounced leave of absence, the Legislature shall proceed under section 5 as if the Chief Justice were a legislator, after 7 days of absence.
Leave of Absence
8. Any official under the Constitution shall announce leaves of absence exceeding three (3) days.
9. The Chief Executive shall appoint an Acting Chief Executive for leaves of absence exceeding three (3) days.
10. The Delegate shall designate an Acting Delegate for leaves of absence exceeding five (5) days.
11. The Chief Justice shall designate a member of the Court as Acting Chief Justice for leaves of absence exceeding five (5) days.
Order of succession
12. Should the office of Chief Executive fall vacant with 14 days or more of term left, the Chair Potato of the Legislature shall become Acting Chief Executive.
13. Should the Chair Potato be unwilling or unable to assume the role, the Chief Justice of the Supreme Court of Spiritus shall become Acting Chief Executive.
14. Should both officials be unwilling or unable to assume the role, a special election shall be conducted if there are more than 14 days of term left, otherwise the office shall remain vacant until after the general election.
Tenure, special election
15. An Acting Chief Executive may not serve in that capacity for more than 30 days, after which a special election must be conducted, unless there are fewer than 14 days of term left.
16. The Legislature may at any time replace an Acting Chief Executive at their discretion with either the Chair Potato or the Chief Justice by resolution, which shall require a 2/3 supermajority to pass.
17. A special election shall always be conducted if the office of Delegate falls vacant.
